UA: April 27, 2011 Letter to President Skorton

Dear President Skorton,

At its meeting today the University Assembly passed a motion that alters the Campus Code of Conduct.

“Be it resolved that, in cases of sexual violence and sexual harassment (as identified in Sections 1(A) and 1(C)) arising under the Campus Code of Conduct, the standard of proof will be preponderance of evidence and all rights of appeal afforded to the accused will also be afforded to the complainant.”

We want to make it clear that the UA’s intention was to comply with this requirement from the “Dear colleague” letter, and nothing more.This preponderance of evidence standard is intended to only apply to sexual violence and sexual harassment.

If you could approve this change promptly then the JA could proceed with a case she has scheduled for 10 May. Thanks so much!
