I. Update from University Assembly

R. Helms (past chair of the CJC and no longer a member) was asked to make a presentation on the last actions of the UA having to do with a recommendation from the CJC for a revision of Title Three; II.V. concerning the intoxication in underage students. RH reported that the UA had turned down the proposed revision of the code by a vote of 30 to 4.

The CJC deliberated on the question of whether to insert the medical amnesty protocol into the policy notebook,. The committee agreed unanimously to recommend that this be done, and that reference be made to the protocol at Title Three.II.V of the code, so that it will be clear that it is desirable to intervene in these circumstances. Peggy Beach will approach David Yeh to see how the language should be drafted and where it will be positioned in subsequent editions of the hardcopy versions of the policy notebook. In the meantime it can be added to the electronic versions. The UA will be informed that this will happen.

The CJC will have a discussion at a forthcoming meeting about the issue of the defense of alcohol use by underage students on campus, the abuse of alcohol by any students on campus, and any relationship that these conditions might have to a tolerance of drug use on campus.

II. Vacancies on CJC and Hearing Board; schedule for Hearing Board interviews

Vacancies on the CJC: 2 undergraduate seats — R. Alley will inquire about interest; 1 employee seat — E. Lowe will inquire; 1 faculty — M. Hatch will talk to the Dean of Faculty office Vacancies on the HB: faculty and staff are complete: there are presently 7 student vacancies. Applications will be solicited: the CJC set the following time, date, and place for the interviews:

Wednesday, 26 October, 11:00 to 12:30 in 273 Myron Taylor.

All CJC MEMBERS respectfully requested to come, if at all possible.

III. Proposal by the Office of the Judicial Administrator

That there be an alternative process, someone or some smaller group than the complete hearing panel as defined in the Code, who could immediately make a review of the case when it is shown conclusively by the JA’s office that such a review cannot take place by the Hearing panel due to unavailability of a sufficient number and distribution of HB members. (A memo outlining this proposal will be formulated by the JA’s office.)

Comment by CJC members: The U.A. would probably never agree to having the right to appeal to the hearing board diluted or suspended, so if any alternative process was devised, it would have to have all the quality and level of review as currently provided for by the HB.

IV. Schedule Remaining Meetings

The next meeting of the CJC was scheduled for Wednesday, 16 November, 12:15–1:15pm in 273 Myron Taylor Hall, unless otherwise notified.
