Codes and Judicial Committee Meeting Minutes November 5, 1996 3:00 - 4:00 103 Day Hall

Attending Members: David Delchamps, Faculty: Jamesa Drake, Undergraduate Student; Randy Hausner (Acting Chair), Staff; Greg Heibel, Graduate Student; Laury Incorvaia, Undergraduate Student; Michael Kazarinoff, Faculty; Barbara Krause, Judicial Administrator, Ex-Officio; Ellis Loew, Faculty; Kenna Madigan (Acting Secretary), Staff; Christopher Norwood, Convener/University Liaison; and Kathleen Rourke, Staff.

Randy welcomed everyone to the first meeting of the CJC for the academic school year 1996–1997 and members introduced themselves to one another

It was decided that Randy and Kenna would act as chair and secretary respectively for the first meeting and at the next meeting the committee would vote on the positions. Randy asked that a new Chair be selected due to his time comittments. He would continue being active with the committee, but would decline the chairmanship.

The committee felt that there were two remaining issues from last year that needed to be discussed which included the rape case at Virginia Tech. and the sexual harrassment policy.

Barbara brought up issues that she felt needed discussion via the CJC. Those issues included:

1. Public lewdness
2. Right to confront accuser
3. Jurisdiction over students
4. Clairification regarding the number of people to sit on a “show cause” hearing
5. Better organization of the campus code to make it more “readable”
6. NYS legalization of noxious sprays

A discussion was had as to how frequently and when the committee shall meet. The next meeting is scheduled for Monday, November 18, 1996 in 103 Day Hall. Christopher is unable to attend, but will speak to John Sherry to see if his schedule permits his attending in his place as the second convener/university liaison.

Christopher asked to review the November 7, 1995 minutes of the CJC meeting regarding public lewdness so that he may take this information to the UA.

Laury requested that when the sexual harrassment policy committee reconvenes that the CJC and that particular committee have a cooperative relationship when discussing changes to the existing policy/code which defines sexual harrassment so that possible changes can be agreed/acted upon.

Kathleen felt that a discussion needed to take place regarding the actual definition of sexual harrassment due to new components that have been recently raised, such as computer harrassment, etc.

Michael felt that an update on the general computing policy was needed.

New policy handbooks are to be distributed to the committee members.

Kathleen gave a short history of the CJC to update/inform members.

The committee discussed the noxious spray law that took effect November 1, 1996 which legalized possession of such materials in a defensive manner in New York State. Issues were raised as to whether or not possession should be legalized/restricted on campus. Ellis felt that reiterating the NYS regulation and adding it to the existing code could be a solution. Christopher raised the issue as to whether or not people on campus need more “weapons”. It was felt that that particular issue was a question for the Senate. Kathleen also felt that a possible footnote of the NYS law in the Code could be a solution. Laury raised the issue as to whether or not Cornell could/should deny students the right to possess a noxious spray when New York State doesn’t. Greg felt that the issue of self defense is something that needed discussion as well. Kenna raised the issue as to whether or not Barb’s office could decide whether the use of the noxious spray was in self defense or needed to be considered endangerment. Randy will distribute the new NYS law to committee members so that we can possibly interpret/add/restrict the use of noxious sprays to the existing policy/code.
